These Terms and Conditions (“Terms”) govern your use of thebrandlanguage.com and create.thebrandlanguage.com (collectively, “the Service”), operated by thebrandlanguage (“we”, “our”, or “us”), based in Bengaluru, Karnataka, India.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

The short version: Use the Service honestly, don’t misuse it, own what you create with it, and understand that AI-generated outputs are a starting point — not professional advice. We’re not liable if things go wrong beyond our reasonable control.

1. The Service

thebrandlanguage is an AI-powered brand language generator. You provide a website or store URL and answer intake questions; we generate a brand language document including positioning, tone of voice, customer personas, and related brand assets.

The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or that the generated outputs will meet your specific requirements.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the authority to enter into these Terms on behalf of yourself or the business you represent.

3. Your account and document

The Service does not require account registration. Your generated brand language document is accessible via a unique shareable URL. You are responsible for keeping this URL secure. We are not liable for unauthorised access to your document if you share the URL with others.

4. Document active periods and extensions

  • Free documents — active for 7 days from generation. After 7 days the document and all associated data are permanently deleted.
  • Extended documents — active for 12 months from the date of extension payment. A further extension can be purchased before expiry.
  • Expired documents — we do not guarantee recovery of expired documents. Once deleted, the data cannot be restored.

Pricing for extensions is displayed at the point of purchase and is subject to change. Changes to pricing do not affect documents that have already been extended at a previously agreed price.

5. Ownership of generated content

You own the brand language document generated for you. You may use it for any lawful purpose — commercial or personal — without restriction.

We do not claim ownership of your generated output. However, we may use anonymised, non-identifiable examples of generated outputs for marketing and demonstration purposes, unless you have opted out of gallery inclusion or requested otherwise.

You retain responsibility for ensuring that the inputs you provide (your URL, your brand details) do not infringe any third-party intellectual property rights.

6. AI-generated content disclaimer

Brand language documents are generated by AI based on your inputs. While we work to ensure high-quality outputs:

  • Generated content is a starting point, not a final deliverable
  • We do not guarantee that AI-generated positioning statements, tone of voice guidelines, or personas are accurate, complete, or suitable for your specific business context
  • Generated outputs do not constitute legal, financial, marketing, or professional advice
  • You are responsible for reviewing, editing, and verifying all generated content before use
  • AI outputs may occasionally contain errors, inconsistencies, or outputs that do not reflect your brand accurately

7. Acceptable use

You agree not to use the Service to:

  • Generate brand language for businesses engaged in illegal activities
  • Impersonate another brand, person, or entity
  • Submit URLs or content that infringe third-party intellectual property rights
  • Attempt to reverse-engineer, scrape, or extract data from the Service in bulk
  • Use the Service in any way that disrupts, damages, or impairs it
  • Resell or commercially redistribute the Service without our written permission

We reserve the right to suspend or terminate access to the Service for users who violate these Terms.

8. Gallery submissions

If you choose to submit your generated document to the public gallery, you grant us a non-exclusive, royalty-free licence to display it at thebrandlanguage.com/gallery/ for as long as it remains in the gallery. You may request removal of your document from the gallery at any time by contacting hello@thebrandlanguage.com.

Gallery documents are public and accessible to anyone with the gallery URL. Do not submit your document to the gallery if it contains sensitive or confidential business information.

9. Payments and refunds

Payments for document extensions are processed by UPI / Razorpay. By making a payment, you agree to the UPI / Razorpay terms of service.

All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

Refund policy: Because brand language documents are generated instantly and the service is delivered immediately upon payment, we do not offer refunds once a document extension has been activated. If you experience a technical failure that prevents document access, contact us at hello@thebrandlanguage.com within 7 days and we will investigate and remedy the issue.

10. Intellectual property

The Service, including our website design, software, prompts, and all content we have created, is owned by thebrandlanguage and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without our express written permission.

The thebrandlanguage name and logo are our trademarks. You may not use them without our permission.

11. Third-party services

The Service integrates with third-party providers including Anthropic (AI generation), Cloudflare (hosting), Razorpay (payments), and Google Analytics. Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

12. Limitation of liability

To the maximum extent permitted by applicable law:

  • thebrandlanguage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim
  • We are not liable for losses arising from AI-generated content that is inaccurate, incomplete, or unsuitable for your purposes
  • We are not liable for data loss resulting from document expiry where adequate notice was provided

Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless thebrandlanguage, its founders, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when the Terms were last revised. Continued use of the Service after changes constitutes acceptance of the updated Terms.

We will notify registered users by email of material changes to these Terms where reasonably possible.

15. Governing law and disputes

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
